Federal Legality: The 2018 Farm Bill
The Agriculture Improvement Act of 2018 (commonly called the Farm Bill) federally legalized hemp and hemp-derived products, including CBD, as long as the product contains less than 0.3% THC by dry weight. CBD coffee made from hemp-derived CBD is legal to buy, sell, and ship across state lines under federal law.

State-by-State Considerations
While CBD is federally legal, some states have additional regulations around CBD in food and beverages. The vast majority of states allow the sale and consumption of hemp-derived CBD products. A few states have restrictions on CBD in food products specifically, though enforcement varies.

CBD Coffee and Drug Testing
This is one of the most common concerns about CBD coffee. Here is what you need to know:
Standard drug tests screen for THC, not CBD. The standard urine test (immunoassay) looks for THC-COOH, a metabolite of THC. Pure CBD does not produce this metabolite.
Broad-spectrum CBD (what Buddha Beans uses) has zero THC. This eliminates the risk that comes with full-spectrum products, which contain trace amounts of THC (up to 0.3%). While 0.3% THC is unlikely to trigger a positive test, we remove all THC entirely to give our customers peace of mind.
No product can guarantee a negative drug test. We are transparent about this. While our broad-spectrum CBD contains non-detectable THC and the risk is extremely low, factors like test sensitivity, cross-reactivity, and individual metabolism mean no CBD company should make a 100% guarantee.

You can travel domestically (within the US) with hemp-derived CBD coffee. The TSA has stated that hemp-derived CBD products are allowed in carry-on and checked bags.
