Is CBG coffee legal? A clear answer for 2026
Short version: yes, when it is made from hemp and tested properly. Here is the longer version, because the details matter and the rules are shifting.
The short answer
Hemp-derived CBG is federally legal in the United States. The 2018 Farm Bill legalized hemp and the compounds in it, including CBG, as long as the finished product contains no more than 0.3% Delta-9 THC by dry weight. Our CBG coffee is made from compliant hemp and tested to meet that limit.
The legal basis
The 2018 Farm Bill defines hemp as the cannabis plant and its derivatives, extracts, and cannabinoids with no more than 0.3% Delta-9 THC by dry weight. Because that definition covers the cannabinoids in compliant hemp, CBG qualifies. CBG pulled from low-THC hemp is the same compound either way, which makes it a hemp derivative and federally legal under the bill.
Why CBG sits in a comfortable spot
CBG is non-intoxicating. It does not get you high. Legal experts have noted that non-intoxicating cannabinoids like CBG tend to draw less enforcement attention than intoxicating ones. That does not make it a free-for-all, but it is a calmer corner of hemp law.
State laws can differ
Federally legal does not always mean legal everywhere. A few states add their own restrictions on hemp cannabinoids. If you are unsure, check your state rules before you buy.
The FDA still has a say
The Farm Bill legalized hemp, but it did not hand cannabinoids a pass under food and drug law. The FDA still regulates how these products are sold and what claims companies can make. That is one reason we do not claim CBG treats or cures anything. We will not, because it would be neither honest nor legal.
What is changing in late 2026
This is worth knowing. A federal update, Section 781 of the Continuing Resolution, takes effect on November 12, 2026. It will define hemp products by their total THC rather than Delta-9 alone, and it excludes lab-synthesized cannabinoids. Because CBG occurs naturally in the plant, naturally derived CBG like ours should stay covered. We are watching the details closely.
How to buy CBG coffee safely
One rule: look for lab results. A trustworthy CBG product comes with a Certificate of Analysis from a third-party lab showing Delta-9 THC under 0.3% and the actual CBG content. Ours is third-party tested, broad-spectrum, and USDA Organic.
