On that date, Section 781 of Public Law 119-37 starts measuring hemp by total THC and caps finished hemp products at 0.4mg of total THC per container. State rules on CBD in food vary on top of that.

Federal CBD Regulations: The 2018 Farm Bill and the 2026 Change

The most significant development in U.S. hemp law was the passage of the 2018 Farm Bill (officially the Agriculture Improvement Act of 2018). That law removed hemp from the DEA's controlled substances list.

The 2018 Farm Bill defined hemp as Cannabis sativa L. plants containing no more than 0.3% delta-9 THC by dry weight. Starting November 12, 2026, Section 781 of Public Law 119-37 replaces that definition with one that counts total THC, including THCA.

FDA Oversight

Even after the 2018 Farm Bill, the FDA still regulates CBD products. As of October 2026, the FDA had not approved CBD as a "dietary ingredient" or "food additive" for food use.
